Solution
here are the instructions for adding printing and scanning for Leopard Macs if the included software does not work.
1. Go to system preferences, printers, and when you click add (the plus sign at the bottom left) the 8860dn should show up as available.
2. Go to
this site
and download the driver and install, then restart. This adds scanning functionality.
3. The Brother Control Center should appear in the top right bar on restart, right click and select Open. You should see 8860DN on the top left drop down in the Control Center, change that to "other..." and then find your MFC and check the scan option and make sure to put in a unique name.
